WE Soda Ltd (together with its subsidiaries, “WE Soda”), the world’s largest producer of soda ash, notes the announcement from the District Court of The Hague in the Netherlands (the “Court”) regarding the patent infringement case brought by Solvay S.A. against Kazan Soda in relation to the method it uses for treating purge.
The Court has issued an injunction which prohibits WE Soda from offering, using and selling product from Kazan Soda in The Netherlands and storing or importing Kazan Soda product into the Netherlands for any of these purposes.
The judgement is solely in relation to soda ash and sodium bicarbonate produced at Kazan Soda and has no bearing on our production from Eti Soda or from our Wyoming facilities which can still be sold in the Netherlands.
Kazan Soda will appeal the decision at the Court of Appeal in The Hague, which provides a full, new evaluation of the case.
There will be no impact on the financial or operating performance of WE Soda. All WE Soda customers, which are supplied with product in or through the Netherlands, will continue to be supplied from Eti Soda and, where applicable, our Wyoming facilities without any disruption.

“We are appealing this judgement and while this process is underway, we have adjusted our supply arrangements so that we are able to continue serving all our customers, seamlessly. We have patents in place for all the key elements of our production process and we are confident in the robustness of our intellectual property.”
